Limited Public License

The purpose of this Limited Public License is to make the articles on the RealFact website "free" (In the sense of freedom). The Limited Public License affords everyone who requests and receives such permission, the freedom to copy and redistribute it, with or without modifying it, either commercially or non-commercially. This License protects RealFact and the author against modifications made by others, while preserving their right to credit for their work.

RealFact is the 'Licensor' who offers Articles to Users under this Limited Public License.

An 'Article' refers to any copyrightable group of sentences or words published on the RealFact website, describing or discussing a certain topic.

'Author' means the RealFact website user or member who created and posted the Article on the RealFact website.

The 'User' is any individual or entity that exercises rights under this License.

Anyone who wishes to publish or exercise any rights to the articles available from the RealFact website may request permission to do so in the License Request are of the RealFact website in the prescribed form. Upon approval of such request by RealFact, the requestor may exercise such approved rights in terms of this Limited Public License.

By exercising any rights to the articles published on the RealFact website, the user accepts the terms and conditions contained in this Limited Public License, as well as Terms And Conditions posted on the RealFact website, and agrees to be bound by them. RealFact grants the user the rights contained herein in consideration for the user's acceptance of the terms and conditions set forth in this Limited Public License.

The User accepts this Limited Public License if the user copies, modifies or distributes any Article available from the RealFact website in a way requiring permission under copyright law. An individual or entity who has previously violated the terms of this License with respect to any Article by the Author or RealFact, will not be deemed to be a lawful User under this license, unless such unlawful user has received express permission from the Licensor to exercise rights under this License, despite a previous violation.

This Limited Public License applies to any Article published on the RealFact website.

Any articles published on the RealFact web site is provided under the terms of this Limited Public License. Copyright and/or other applicable law protect the articles. Any use of the articles, other than as authorized under this Limited Public License and the applicable copyright law, is prohibited.

RealFact, its author(s) or designee owns the copyright to the Article.

Nothing in this Limited Public License is intended to reduce, limit, or restrict anyone's rights to make fair use of the Article, or any other rights, nor is it intended to place other limitations on the exclusive rights of the copyright owner under the applicable copyright or other laws.

The Licensor hereby grants the user a worldwide, royalty-free, non-exclusive license to copy, publicly display, publicly publish, and distribute the Article in any medium, either commercially or non-commercially, provided that the author and the RealFact Website is duly attributed.

Each time the user copies, publicly displays, publicly publishes, or distributes the Article or any Derivatives thereof, RealFact offers a Limited Public License to the recipient of the Article on the same terms and conditions as the License granted to the user under this Limited Public License.

If the User copies, publicly displays, publicly publishes, or distributes the Article or any Derivatives thereof, the User must keep all copyright notices for the Article intact and give the author and the RealFact website credit.

The format of credit should be reasonable to the medium used and to the extent reasonably practicable. The credit should convey the name (or pseudonym if applicable) of the author (if supplied), the title of the Article (if supplied) and the Uniform Resource Identifier (URL) for the RealFact website (currently www.realfact.net). At a minimum, such credit must appear where any other comparable authorship credit appears, or should appear, and as prominent as such other comparable authorship credit.

Neither the user, nor the author, will have the right to use the name 'RealFact', www.realfact.net, or any related logo or identifying mark of RealFact without the prior written consent of RealFact, except for the limited purpose of indicating to the public that an Article is licensed under this Limited Public License or as provided in the Terms And Conditions. Any permitted use will be in compliance with RealFact's usage guidelines, as RealFact may publish on the RealFact website, or otherwise make available.

Unless the parties specified otherwise in a separate writing, RealFact offers the Article 'voetstoots' or 'as is' and 'as available' as Licensor, and the Licensee acknowledges and agrees that he has acquainted himself with the Article, and that he accepts it in its present condition, and that he relies entirely upon his own investigation and observations with regard to the Article and that neither the Author nor the Licensor has made any warranty or representation whatsoever regarding the Article, including but without limiting the scope of the disclaimer, of title, merchantability, fitness for a particular purpose, non-infringement, the absence of latent or other defects, accuracy, the presence or absence of errors, whether or not discoverable.

In no event will the Licensor be liable to the user or any third party, on any legal theory for any damages arising out of the use of the Article, even if the Licensor has been advised of the possibility of such damages.

RealFact makes no warranties regarding the information provided, and disclaims liability for damages resulting from its use.

Any indulgence or anything else granted by the Licensor will not be considered to impair any of the rights of the Licensor in terms of this License, or affect any rights whatsoever of the Licensor.

If any part of this License is invalid or unenforceable under applicable law, it shall not affect the validity or enforceability of the remainder of the terms of this Limited Public License. Without any further action by the parties to this agreement, such invalid or unenforceable portion shall be reformed to the minimum extent necessary to make such provision valid and enforceable.

This License constitutes the entire agreement between the parties with respect to the Article. There are no understandings, agreements, or representations with respect to the Article not specified herein. Any additional provisions that may appear in any communication from the User shall not bind the Licensor.

Any alterations, waivers or concessions of, or to, any part of this License shall be null and void, unless in writing and signed by RealFact, the Licensor and Licensee, or their duly empowered representatives.

The rights granted to the user under this Limited Public License will terminate automatically upon any breach of the terms thereof by the User. The Licenses of individuals or entities who have received copies or Derivatives of the Article from the User under this License, however, will not terminate, provided such Users remain in full compliance of this Limited Public License.

The Licensor reserves the right to release the Article under different license terms, or to stop distributing the Article at any time. Any such election will not withdraw this Limited Public License, and it will continue to be in full force and effect unless terminated due to any breach of these terms by the User.

Provisions that protect the rights of RealFact and the author and limits their liability for any damages or claims will survive any termination of any user's rights under this agreement.

Although the following are not terms or conditions under the Limited Public License, Users are requested to:

Provide notification on the RealFact website of the User's intent to publish an Article more than 7 days before such publication. This notification will allow the author(s) time to provide updates to the Article.

Clearly indicate substantial modifications to, or deletions from the Article, or else, at least describe them in an attachment to the Article.

Offer a copy of any tangible publication of the Article, or access to intangible publications to its author(s) and Licensor at no cost.
