1. This sole and exclusive mandate grants the seller's agency the exclusive right to market the property for sale and precludes all other agents from advertising the property for sale, but shall not constitute a power of attorney.

9. The seller undertakes to accept an offer submitted by the agent from an able and willing purchaser, should such an offer comply fully herewith, but the seller shall have the right, at his own discretion, to refuse any offer which includes any stipulation he cannot agree to.
10. Obligations of the agent:
10.1 The seller's agent shall not accept this mandate before preparing a motivated comarative market anaysis for the property, containing details of comparable properties that have recently been sold in the area surrounding the property, a copy of which shall be submitted to the seller within 24 hours of accepting this mandate.
10.2 The seller's agent shall furnish the seller with a copy of this agreement within 24 hours after accepting this mandate.
10.3 The seller's agent agrees to act for and on behalf of the seller, and undertakes to protect the seller's interests above any other party's interests.
10.4 The seller's agent shall allow any buyer to appoint an agent to represent the buyer's interests and will not, through any action or inaction, obstruct the buyer's agent from performing his/her duty to the buyer, unless such action or inaction is required to protect the interests of the seller.
10.5 The agents shall keep confidential any information furnished by the seller, which the seller requires to be kept confidential, or which can influence the sale and purchase of the property negatively, except where such information must be disclosed to protect the seller.
10.5.1 The agent herby accepts the seller's instruction to keep all personal information, provided in this document and in the course of this agency, secret.
10.6 The agent shall forthwith submit, for the seller's consideration, all offers received for the property.
10.7 The seller's agent undertakes to implement the marketing plan attached hereto as Annexure A.
10.8 The seller's agent shall submit the copy for any planned advertisement to the seller for approval before publication.
10.9 The seller's agent shall submit a written feedback report to the seller, listing all prospective purchasers introduced to the property, their comments about the property and the price, as well as details of any advertising featuring the property.
10.10 The seller's agent shall immediately upon acceptance of an offer submit the concluded agreement of sale to the conveyancers, and keep the seller informed about the progress of the transfer of ownership on a weekly basis.
10.11 The seller's agent shall make good any damages incurred by the seller whilst the seller’s property was under the custodianship of the agent.
11. Either party shall be entitled terminate this mandate upon written notice.
12. For the purposes of this agreement, the parties agree to accept email notification as written notice.
